What should I do first?
Photograph the damage, notify in writing, and open a claim on your own seguro de hogar the same day — your policy covers damage inside your flat even when the water came from someone else’s, and it then recovers from whoever was liable. Who ultimately pays depends on where the water starts. From the neighbour’s own pipework or appliance, it is their insurer. From a bajante (the shared soil stack), a riser, the roof or the façade, it is a common element and the cost falls on the comunidad de propietarios, usually through a derrama — a one-off levy split between owners by the coefficient written into your deeds, not equally. Replacing a section of bajante runs 800 € to 2,000 €; redecorating an 80 m² flat afterwards, 1,400 € to 2,400 €. Allow two to six weeks of drying before any painting, whatever the schedule says.
The first 48 hours
- Photograph the damage with a visible date, and repeat daily so the progression is on record
- Notify the neighbour in writing. A burofax is the Spanish equivalent of recorded delivery and carries legal weight
- Inform the administrador de fincas, the building manager: they hold the building’s insurance
- Open a claim on your own seguro de hogar, the standard Spanish home policy nearly every flat has
- Repair nothing beyond what stops further damage until the loss adjuster has seen it
The mistake almost everybody makes
Waiting for the neighbour to act before opening your own claim. A claim is not an accusation and commits you to nothing.

Who pays depends on where the water came from
Source inside the neighbour’s flat
An internal pipe, a washing machine, a failed shower seal. The neighbour answers, normally through the responsabilidad civil — public liability — cover included in most Spanish home policies. They do not pay out of pocket; their insurer does.
Source in a communal element
The main soil stack, a rising main, the roof, the façade or a communal terrace. Here the comunidad de propietarios — the owners association — answers through the building’s own policy. No individual fault is involved: it is building maintenance.
The grey area: private-use terraces
Exclusive use for one flat, communal structure and waterproofing. Which is which depends on the estatutos, the building’s own constitutional rules — the single most argued-about scenario in Barcelona blocks.
If nobody accepts responsibility
Your own policy pays and then pursues whoever was liable. That is subrogación, and it is why a prompt claim beats winning the argument with your neighbour.
Repair
When can the ceiling actually be repaired?
Painting over a stain before the source is fixed and the structure is dry guarantees you will be doing it twice. The drying is the part people skip.
The correct order
- Confirm the leak is stopped, not just that the stain stopped spreading
- Let the substrate dry completely: in a concrete slab that is weeks, not days
- Cut back blown plaster and flaking paint to sound material
- Apply a stain-blocking primer, or the mark bleeds through within months
- Paint the whole surface, not the patch, so the repair does not read as one
How to know it is dry
A moisture meter reading from the contractor, or the plastic sheet test: tape a square of plastic tightly to the surface for forty-eight hours and see whether moisture appears underneath. Both cost almost nothing.
If you are abroad
Handling a leak in a flat you are not in
This is a common situation for overseas owners and it is manageable, but the evidence decays fast and the insurer’s deadlines do not pause because you are abroad.
What to arrange in advance
- Know your policy number and your insurer’s claims line before you need them
- Have the building manager’s details and a named local person who can let a loss adjuster in
- Fit an automatic leak-detection shut-off valve: in an empty flat it is the highest-value fitting there is
- Put a wifi water and humidity sensor in the bathroom, kitchen and under the boiler
- If the flat is let, tell the tenant to photograph and report immediately rather than wait
What to ask whoever is there
Photographs of the whole affected area rather than close-ups: the extent is more diagnostic than the texture. Whether the stain grows with rain, overnight, or steadily. And whether the flat above is occupied at all.
A note on deadlines
Spanish home policies require notification within a short window of you becoming aware of the damage, and being abroad does not extend it. Open the claim the day you are told.
